1. Agreement to Terms

By accessing or using Blorp ("the Service"), operated by Blorp Technologies Inc. ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is available at goblorp.com.

2. Description of Service

Blorp is an SMS marketing platform designed for local businesses. The Service allows you to send promotional messages, appointment reminders, and updates to your customers via SMS. Features include bulk messaging, two-way conversations, contact management, call forwarding, message scheduling, and analytics.

3. Account Terms

  • You must be at least 18 years old to use the Service.
  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • One person or business may not maintain more than one free account.

4. Acceptable Use & SMS Compliance

You agree to use the Service in compliance with all applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any applicable state or provincial regulations. Specifically, you agree to:

  • Only send messages to recipients who have provided prior express written consent to receive SMS communications from you.
  • Honor all opt-out requests immediately. Blorp automatically tracks opt-outs, but you are ultimately responsible for compliance.
  • Not send messages that contain illegal, deceptive, misleading, or fraudulent content.
  • Not use the Service to send spam or unsolicited messages.
  • Include your business name in messages so recipients know who is contacting them.
  • Maintain records of consent for each contact you message through the Service.
  • Not use the Service for any purpose that violates Twilio's Acceptable Use Policy or messaging guidelines.

We reserve the right to suspend or terminate accounts that violate these terms or generate excessive opt-out rates.

5. Contact Data & Imports

You may import contacts via CSV file upload or through Google Contacts integration. You represent and warrant that you have the right to contact each person whose information you upload or import into the Service, and that you have obtained proper consent to send them SMS messages. We do not verify consent on your behalf.

6. Billing & Payment

  • Your first 50 messages are free. No credit card is required for the free tier.
  • Paid plans are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • Plan pricing, message limits, and per-message overage rates are listed on our pricing page and may change with 30 days' notice.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds are not provided for partial billing periods.
  • We reserve the right to suspend accounts with overdue payments.

7. SMS-Specific Terms

  • Message delivery depends on third-party carriers and is not guaranteed. We are not responsible for messages that are delayed, undelivered, or filtered by carriers.
  • Standard message and data rates may apply to recipients of your messages.
  • Phone numbers provisioned through the Service are owned by our SMS provider (Twilio) and are assigned to your account for the duration of your subscription.
  • Call forwarding routes incoming calls on your Blorp number to a destination number you specify. Call quality depends on carrier networks.
  • We may impose rate limits or sending caps to prevent abuse and maintain service quality.

8. Twilio Messaging Terms

Blorp uses Twilio as its underlying telecommunications provider to send and receive SMS messages and handle phone calls. By using the Service, you also agree to comply with Twilio's policies:

In particular, Twilio's Messaging Policy requires that you only send messages to recipients who have opted in, that you identify yourself in messages, and that you honor opt-out requests. Violations of Twilio's policies may result in immediate suspension of your messaging capabilities, phone number deactivation, or account termination by Twilio and/or Blorp. Blorp is not liable for actions taken by Twilio in response to policy violations.

9. Intellectual Property

The Service, including its design, features, and code, is owned by Blorp Technologies Inc. You retain ownership of the content you create and the contact data you upload. By using the Service, you grant us a limited license to process your content solely to provide the Service to you.

10. Limitation of Liability

To the maximum extent permitted by law, Blorp Technologies Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, abusive messaging behavior, or non-payment. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or an in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Blorp Technologies Inc. is incorporated, without regard to conflict of law provisions.
